Mr. Ed Hamilton - 6615 Hwy. #10 N.W. - Stated that be is opposed to the <br />operation locating on the proposed site. <br />} The Commission proceeded to review the proposed findings of fact. <br />Motion by Commissioner Shumway and seconded by Commissioner Howell to <br />recommend that City Council adopt the proposed findings of fact relating to <br />Commercial Asphalt Company's request for a conditional use permit to <br />establish a bituminous asphalt plant in the I -1 Industrial District. <br />Further Discussion: Commissioner Hendriksen recalled that some of the <br />citizens made comments during the Flintwood 5th Addition public hearing <br />earlier this evening regarding the odor that is emitted from Commercial's <br />operation currently located in that area; suggested adding language to <br />items 17 and 18 to indicate concern for odors as well as air quality and <br />another item 24 to indicate comments made during the Flintwood 5 public <br />hearing regarding odor from the existing asphalt operation across the <br />street. Mr. Data stated that he did comment during the Flintwood 5 public <br />hearing that noise and odor from the asphalt operation is a good reason not <br />to develop apartment buildings in that area. <br />Amendment by Commissioner Hendriksen and seconded by Comissioner Howell to <br />add the following to the proposed findings of fact: <br />Item #24: That the Planning and Zoning Commission has received <br />several comments regarding the potential odor from the proposed site <br />and existing odor at the existing site. <br />Amendment carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway, <br />Hendriksen, LaDue, Holm, Howell and Terry. Voting No: None. <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway, <br />Hendriksen, LaDue, Holm, Howell and Terry. Voting No: None. <br />Ms. Norris stated that she has not yet drafted a proposed conditional use <br />permit for P &Z consideration. <br />Motion by Commissioner Holm and seconded by Commissioner Shumway to table a <br />decision regarding Commercial Asphalt Company's request for a conditional <br />use permit until city staff has drafted same. <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway, <br />Hendriksen, LaDue, Holm, Howell and Terry.
