From Ae.e.~ory Stroet.te M.~imum Re,.ht ~\l. <br />Al1owance~ Case Of Mr. Jeff Erikson: ~ <br /> <br />Mr. Erikson was present. <br /> <br />Chairman Zimmerman noted that the City Attorney bas determined tbat even <br />though the property is located in the B-1 Business district. the principal <br />use of the property is res idential; therefore, Mr. Erikson's acce s sory <br />structure should be subject to residential standards. <br /> <br />Ms. Norris noted that the 16 foot height limitation for accessory <br />structures applies to commercial and industrial zones as well as <br />residential zones. Ms. Norris also noted that the City Attorney has also <br />stated that if Mr. Erikson desires to use the accessory structure for <br />commerical purposes, he would have to go through the conditional use <br />process because his primary use of the property is residential. <br /> <br />The Commission proceeded to review the proposed findings of fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Peterson to <br />adopt Findings of Fact 0160 relating to Mr. Erikson's request for a <br />variance from the maximum height allowance for accessory structures, <br />amended as follows: <br /> <br />Item 18 - Should read as follows: 'That the Applicant is proposing <br />to construct an accessory structure approximately 22 feet in height, <br />which is also higher than the principal structure.' <br /> <br />~otion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, <br />Hendriksen and Peterson. Voting No: None. Absent: Commissioners Howell, <br />Shumway and LaDue. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Peterson to <br />deny, based on the findings of fact, Mr. Erikson's request for a variance <br />from the maximum height allowance for accessory structures. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman. Commissioners Deemer, <br />Hendriksen and Peterson. Voting No: None.
