Goodrich, City <br /> <br />Conditional Use Permit <br />15270 St. Francis Blvd. <br /> <br />Zoning Commission <br />Attorney <br />Request of Jeff <br /> <br />Er ick,son, <br /> <br />I t is my understanding that Jeff Er ickson has appl ied for a <br />condi tional use permi t to construct and operate an office and <br />warehouse for an electrical contracting business at 15270 St. <br />Francis Blvd. <br /> <br />As you know, the subject property is in the Ci ty' s B-1 zoning <br />district. In addition, a pre-existing residential home is al- <br />ready located on the property, which pr ior to this time, was <br />the principal use of the property. In addi tion, in 1987 Mr. <br />Erickson applied for a variance to allow for the construction <br />of an accessory building on his property which would have ex- <br />ceeded the height limitation permi tted in a residential zone. <br /> <br />It is my understanding that Mr. Er ickson wants the parcel to <br />remain B-1 and operate a business from the premises as well <br />as live on the site. In addition, Anne Norris advises me that <br />the City would like to keep the property in its present B-1 <br />zone. <br /> <br />It is my opinion that Mr. Erickson's plan is workable. I suggest <br />that because of Mr. Erickson's continued interest in using <br />his property as commercial, and, of course, because it is zoned <br />commercial (B-1), that the residential use be considered non-con- <br />forming, wi th the goal of some day, consistent wi th the Ci ty' s <br />non-conforming use regulation, Section 170.015H, of phasing <br />out the residential use. <br /> <br />If the Commissioners and Mr. Erickson accept this reasoning, <br />which I believe to be the best characterization of the subject <br />property under our zoning ordinance, then Mr. Erickson will <br />not be required to obtain a conditional use permit. He will, <br />however, be required to obtain a si te plan permi t as required <br />by Section 170.017L of the zoning ordinance. <br /> <br />IS <br />
