<br />October 8, 1985 <br />'10: P1aming and Zoning Carlrission <br />FR<JtI: City Attorney and City Planner <br />RE: Carposi tion of Board of Adj ustIrent <br /> <br /> <br />Pursuant to your IT'eeting and discussion with the City Council on <br />October 1 regarding the Board of Adjus~went, City staff <br />researched the watter of the cowpositionof the Board of <br />Mj ustIrent. <br /> <br />M.S.A. 462.354 provides that the following way be the Board of <br />Adj ustIrent: <br /> <br />1. !lhe Ci ty Council; <br />2. ibe Planning Carlrission; <br />3. A canrittee of the Plaming Canrission; or <br />4. An entirely different group. <br /> <br />If the City Council is not the Board of AdjustIrent, the Council <br />way provide that ap,peals of Board of Adj ustwent decisions be <br />directed to it, .Q.t the Council can, by ordinance, decide that <br />the Board of AdjustIrent decisions are final and any appeal would <br />then have to be wade to a oourt. <br /> <br />FOr your infomation, attached is a survey of the cowposition of <br />other canrunities' Boards of AdjustIrent. <br /> <br />If the Cowwission wishes to change the present Board of <br />Adjustwent cowposition and/or procedure, please rake <br />reccmrendations acoordingly. <br /> <br />In addition to this watter, the City Council has discussed, on <br />various occasions, the $90 application fee for the variance <br />process. This fee is to cover costs including pUblishing, <br />postage, and staff tiwe in processing the application. If you <br />feel that this fee should be changed, please rake recowwendations <br />accordingly. <br /> <br />Attach : <br />
