<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Councilnenber <br /> <br />made the motion to acbpt the following findings of fact: <br /> <br />FINDlOOS OF FACT 01_ <br />CDNNIE SKARBAKKA <br /> <br />1. 1hat Ms. Connie Skarbakka, hereinafter referred to as -Applicant,- has <br />properly applied for a conditional use permit to operate an accounting business <br />fram her horne at 17811 Gibbon Street N.W. <br /> <br />2. 1hat the Applicant appeared before the Planning and Zoning Camlission for a <br />public hearing pursuant to City Ordinance on February 4, 1986 and that said <br />public hearing was properly advertised and minutes of that public hearing are <br />her~ incorporated ~ reference. <br /> <br />3. 1hat the subject property is legally described as follows: <br /> <br />Lot 10, Block 1, Deerwood, Anoka County, Minnesota. <br /> <br />4. '!hat the subject property is located within the R-l Residential District <br />and is approximately 5.5 acres in size. <br /> <br />5. 1hat the Standards for Consideration are as follows: <br /> <br />a. 1hat the property is zoned R-l Residential and an accounting business <br />is not a permitted use in this zone; <br /> <br />b. 1hat the adjoining property is ei ther residential or vacant; <br /> <br />c. 1hat there are no other similar uses in the area; <br /> <br />d. 1hat the pro(X>sed use will not create an increase in traffic flow in <br />the area; and <br /> <br />e. 'lhat the pro(X>sed use will not be dangerous or otherwise detrimental to <br />persons residing in the area, or to the public welfare, nor will the <br />proposed use substantially impair the use, enjoyment or value of any <br />property in the area. <br /> <br />6. 'lhat the Criteria for Approval are as follows: <br /> <br />a. 'lhat the operation of the accounting business will not be detrimental <br />to or endanger the public health, safety or general welfare and is not <br />contrary to the established standards, regulations or ordinances of other <br />governmental agencies; <br /> <br />b. 'lhat the accounting business will not be unsi gh tly, undesi reable or <br />obnoxious in awearance and it will not hinder the orderly and harmonious <br />developnent of the City or the R-l Residential District; <br /> <br />c. 'lhat the accounting business will not be injurious to the permitted <br />uses nor unduly restrict the enjoyment of other property in the inunediate <br />vicinity nor substantially diminish and im}';8ir property values within the <br />area; <br /> <br />10 <br />
