<br />Board Member <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #06-_-_ <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br />WHEREAS, Shingobee Builders, Inc, hereinafter referred to as "Applicant," has <br />properly applied for a variance from Section 9.20.25(3)(b) regarding maximum front yard <br />setbacks in the TC-2 Sub-District of the Town Center District, on the property legally described <br />as follows: <br /> <br />Outlot H, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject <br />Property); and <br /> <br />WHEREAS, the Board of Adjustment met on August 3, 2006, conducted the public <br />hearing and adopted fmdings of fact relating to the request for a variance from the maximum <br />front yard setback requirements as part ofthe development of the Subject Property. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY,ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />1. Based on Resolution #06-_-_ adopting Findings of Fact # , a variance to <br />the maximum front yard setback, as established in Section 9.20.25(3)(b) of the Ramsey <br />City Code, is approved for the development of Kl-ein Bank on the Subject Property. <br />2. That the placement of the bank will be developed in accordance with the approved site <br />plan, and the setback from Sunwood Drive shall not exceed 325 feet as measured from <br />the public right-of-way line. <br />3. The Permittee shall install and maintain additional landscaping, benning, and pedestrian <br />fencing, as outlined in the City Staff Review Letter dated July 28,2006. <br />4. The Permittee shall be responsible for all City costs incurred in processing the variance <br />request. <br /> <br />The motion for the adoption of the foregoing resolution was du1y seconded by Board <br />Member , and upon vote being taken thereon, the following voted in <br />favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />8 <br />
