<br />Board Member <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #06-08- <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #_ RELATING TO A REQUEST <br />FOR A VARIANCE TO THE MAXIMUM FRONT YARD SETBACK FOR PROPOSED <br />KLEIN BANK IN THE TOWN CENTER ZONING DISTRICT, SUBDISTRICT TC-2. <br /> <br />WHEREAS Shingobee Builders, Inc hereinafter referred to as "Applicant," has properly <br />applied for a variance from Section 9.20.25, Subd. 3.b, regarding minimum and maximum front <br />yard setbacks in the TC-2 sub-district of the Town Center District, on the property legally <br />described as follows: <br /> <br />Outlot H, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject <br />Property) <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Board of Adjustment conducted a public hearing pursuant to Section9.03.07 of the <br />Ramsey City Code on August 3, 2006 and that said public hearing was properly advertised, <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />2. That the Subject Property is zoned TC-2 Town Center Commercial <br /> <br />3. That properties to the east and north are zoned Town Center. <br /> <br />4. That section 9.20.25, Subd. 3.b, establishes a minimum front yard setback of 0 feet and a <br />maximum structure setback of 15 feet in order to encourage pedestrian friendly design. <br /> <br />5. That the Applicant is requesting a variance from the 15 foot maximum front yard setback in <br />order to construct a bank approximately 325 feet from Sunwood Drive. <br /> <br />6. That the Town Center Design Guidelines for the TC-2 sub-district allows the development of <br />larger scale buildings, which oftentimes results in the structures exceeding the maximum <br />front yard setback. <br /> <br />7. That the approved master plan anticipated some buildings to be set back from Sunwood <br />Drive in this area. <br /> <br />8. That placing all buildings close to Sunwood underutilizes the back of the property. <br /> <br />5 <br />
