Recommendation: Staff recommends that, although drive-thrus are not permitted in this district, a compromise would' be to allow the drive-thru for a designated period of time to accommodate the construction of a coffee shop in the core area of Town Center. Staff recommends that approval is contingent upon landscaping, berming, and fencing additions to preserve the. intent of the pedestrian-oriented, walkable core area. The term for the interim use permit will be 5 years, renewable based on Council approval and the following criteria; 1) The use of the drive thru only for a coffee shop. If the use changes, the interim use permit is null and void. , 2) The addition and preservation of a landscape buffer and a berm between the drive- aisle of the drive-thru and the sidewalk, as shown on the site plan. These trees and tall shrubs must be used to screen the drive-thru and provide a definition of the pedestrian realm. 3) The installation of pedestrian-scale fencing, as approved by Staff, along the sidewalk from the edge of the building to the north entrance, In front of the proposed plantings. 4) The submittal of a revised Landscape Plan and site plan addressing the grading and queuing comments made in the City Staff Review Letter dated July 28,2006. Commission Action: Motion to recommend that City Council adopt findings regarding the request by the applicant for an interim use permit to construct a drive-thru in the TC-l district, -and- Motion to recommend that City Council approve the request for an interim use permit, subject to the conditions referenced above, based on the findings of fact; -or- Motion to recommend that City Council deny the interim use permit request, based on the findings of fact.
