<br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-08- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT TO <br />ALLOW THE CONSTRUCTION OF USE OF A DRIVE-THRU WITHIN THE TOWN <br />CENTER CORE"DISTRICT <br /> <br />WHEREAS, Sharp and Associates (Permittee) has properly applied for an interim use permit, <br />to construct a drive-thru, menu board, and drive aisle in the TC-Core Area district on the north <br />side of the Ramsey Office Plaza located at 7333 Sunwood Drive, or as legally described as <br /> <br />Lot 1, Block 1, Ramsey Town Center 11 th Addition <br /> <br />(Subject Property) <br /> <br />WHEREAS, the Planning Commission met on August 3rd, 2006, conducted the <br />public hearing and recommended <br /> <br />NOW THEREFORE, BE IT RESOL YED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact # , an interim use permit (permit) for the construction and <br />use of a drive-aisle, pick-up window, and menu board for said property as established in City <br />Code, is hereby granted to Sharp and Associates, hereinafter referred to as the "Permittee.," <br />based on the following contingencies: <br />a. The use of the drive thru will only be used in conjunction with the operation of a <br />coffee shop. If the use changes, the interim use permit is null and void. <br />b. The addition and preservation of a significant landscape buffer and a berm between <br />the drive-aisle of the drive-thru and the sidewalk, as shown on the site plan. These <br />trees and tall shrubs must be used to screen the drive-thru and provide a definition of <br />the pedestrian realm. <br />c. The installation of pedestrian-scale fencing, as approved by Staff, along the sidewalk <br />from the edge of the building to the north entrance, in front of the proposed plantings. <br />d. The submittal of a revised landscaping plan indicating these changes requesting in the <br />City Staff Review Letter dated July 28, 2006. <br />e. The submittal of a revised site plan addressing the grading and queuing comments <br />made in the City Staff Review Letter dated July 28,2006. <br /> <br />2. That this Permit shall be valid for 5 years, renewable indefinitely, as long as the applicant <br />complies with the terms and the City approves an interim use permit every 5 ye~rs. <br /> <br />3. That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br /> <br />61 <br />
