<br />FINDINGS OF FACT #0210 <br />MR. DEAN HANSON <br /> <br />1. That Dean Ranson. hereinafter referred to as "Applicant". has properly <br />applied for a Board of Adjustment Variance from the required setback <br />from the Rum River. <br /> <br />2. That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Sections 170.013G and 170.07 of the Ramsey City <br />Code on July 7.1988 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby <br />incorporated as part of these findings by reference. <br /> <br />3. That the subject property is generally known as 15665 Juniper Ridge <br />Drive N. W. and is legally described as follows: <br /> <br />Lot 4. Block 1. Reilley Estates. Anoka County. Minnesota <br /> <br />4. That the subject property is located in the R-IR Rural Residential <br />District and is approximately 1 acre in size. <br /> <br />5. That the subject property is located in the Scenic River Overlay <br />District. <br /> <br />6. That the Applicant is proposing to construct a structure will be <br />located approximately 103 feet from the Rum River. <br /> <br />7. That Section 170.076 of the Ramsey City Code requires structures to be <br />located no closer than 150 feet from the Rum River. <br /> <br />8. That the property immediately south of the subject property has a <br />structure located on it which is located approximately 80 feet from the <br />Rum River. <br /> <br />9. That the property located immediately north of the subject property has <br />a structure located on it which is located approximately 127 feet from <br />the Rum River. <br /> <br />10. That Mr. John Stine. DNR. has reviewed the Applicant's request. <br /> <br />11. That the Applicant has stated that there are exceptional circumstances <br />applying to the subject property. Namely. that the subject property is <br />located in the Scenic River Overlay District and is subject to more <br />stringent setback requirements than properties which are not located <br />in the Scenic River Overlay District. <br /> <br />12. That the Applicant has stated that such variance is necessary for the <br />preservation of the substantial property rights. <br /> <br />13. That the Applicant has stated that the special condition. namely that <br />the property is located in the Scenic River Overlay District. does not <br />result from the actions of the Applicant. <br /> <br />14. That if granted. the variance will not grant the Applicant any special <br />privilege that is denied by the City's Zoning Chapter to other owners <br />of land in the area. <br /> <br />8 <br />
