That Amoco Oil Canpany and North Star Engineering, hereinafter referred <br />to as "Applicant", have properly applied for a Board of Adjustment <br />Variance fran the i.npervious surface coverage' requirements. <br /> <br />2. That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Sections 170.013G and 170.07 of the Ramsey City <br />Code on April 27, 1988 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby <br />incorporated as part of these findings by reference. <br /> <br />3. That the subject property is legally described as follaws: <br /> <br />Lot 1, Block 1, River's Bend Plaza 2nd Addition, <br />Moka COunty, Minnesota <br /> <br />4. That the subject property is located in the B-1 Business District and <br />is approximately one acre in size. <br /> <br />5. That the subject property is located in the Scenic River Overlay <br />District. . <br /> <br />6. That Section 170.076.18 of the Ramsey City Code limits the amount of <br />impervious surface coverage to 30% in the Scenic River Overlay <br />District. <br /> <br />7. That the Applicant is proposing a development which will cover <br />approximately 58% of the subject property with impervious surfaces. <br /> <br />80 T'nat Mr. John Stine, DNR, has reviewed the Applicant's proposal and has <br />stated that if the fol1awing conditions are met, he would recommend <br />approval of the proposed variance: <br /> <br />a) The ponding area shall be excavated to an elevation of 854 feet; <br />b) The top of the manhole shall be at an elevation 855.7 feet; and <br />c) There shall be a skinmer installed around the manhole to prevent <br />floatables from getting into the storm sewer. <br /> <br />9. That the Applicant has stated that there are exceptional circumstances <br />applying to the subject property. Namely, that the subject property is <br />located in the Scenic River Overlay District and is subject to <br />restrictions on impervious surface coverage. <br /> <br />10. Tnat t.n.e Applicant has stated that such variance is necessary for the <br />preservation of substantial property rights. <br /> <br />11. That the special conditions, namely that the property is located in the <br />Scenic River Overlay District, do not result from the actions of the <br />Applicant. <br /> <br />12. That if the variance is granted, the Applicant will not be granted any <br />~cial privilege that is denied by the Zoning Chapter to other owners <br />of land in the B-1 Business District. <br /> <br />2~ <br />
