<br />PROPOSED FINDIN:;S OF FAC!! <br />MR. JelSEPB JENSEN <br />amATIVE BUILDERS AND HCME DESIGN, INC. <br /> <br />1. That Mr. Joseph Jensen of Creative Builders and Hane Design, Inc., <br />hereinafter referred to as flApplicantn has properly applied for a <br />Board of Adjustment variance fran the side yard setback. <br /> <br />2. That the Applicant appeared before the Board of Adjustment for a public <br />public hearing pursuance to Section l70.0l3G of the Ramsey City COde on <br />March 24, 1988 and that said public hearing was properly advertised and <br />that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />3. That the subject property is generally known as 5326 l42nd Circle N.W. <br />and is legally described as follows: <br /> <br />Lot 20, BlOCK 2, Flintwood Hills 2nd Addition, Moka County, <br />Minnesota. <br /> <br />4. That the subject property is located in the PUD Distr ict and is <br />approximately 6900 square feet in size. <br /> <br />5. That the Applicant is requesting a variance fran the side yard setback <br />requirements of Section l70.0l6B of the Ramsey City Code. <br /> <br />6. That Section l70.0l6B of the Ralr.sey City Code specifies the minimum <br />side yard is 10 feet. <br /> <br />7. That the subject property is located in the Flintwood Hills 2nd <br />Aadition roD and in this PUD, a side yard setback of 5 feet is <br />permitted on the garage side. <br /> <br />8. That the Applicant is requesting a variance for an encroachment of <br />approximately 2.5 feet to the side yard setback requirement. <br /> <br />9. Tnat the Applicant is proposing that that portion of the structure to <br />encroach on the required side yard setback will include a tuck-under <br />garage. <br /> <br />10. That the Applicant is proposing a side yard of approximately 7.5 feet. <br /> <br />11. That the Applicant has stated that there are exceptional circumstances <br />applying to the subject property. Namely, that the subject property is <br />narrower (57.5 feet) than most other lots (60 feet) in the Flintwood <br />Hills P"JD. <br /> <br />12. That the Appl icant has stated that such variance is necessary for the <br />preservation of the substantial property rights. <br /> <br />13. That the special conditions, namely the size of the lot, do not result <br />fran the actions of the ll..pplicant. <br /> <br />)3 <br />
