<br />CASE 14: <br /> <br />REQUEST FOR VARIANCE TO CONSTRUCT TO CONSTRUCT A SWIMMING POOL WHICH <br />WILL ENCROACH ON THE REQUIRED SETBACK FROM THE RUM RIVER; <br />CASE OF DUANE AND LINDA KENNEN <br />By: Community Development Director Anne Norris <br /> <br />Background: <br /> <br />Duane and Linda Kennen are requesting a variance to construct a swimming <br />pool which will encroach on the required setback from the Rum Ri.ver at <br />their home at 15845 Juniper Ridge Drive N.W. The Kennens are proposing to <br />construct a 16' x 38' above ground pool to be located approximately 30 feet <br />from the bluff of the Rum River. Section 170.076 of the City Code requires <br />all structures to be set back at least 150 feet from the Rum River. <br /> <br />The Kennens' house is located closer than 150 feet to the Rum River. <br />However, the house was constructed in 1980, prior to the City's adoption of <br />the Scenic River Development standards. <br /> <br />As the property is located within the Scenic River Overlay District, the <br />Kennens' proposal has been reviewed by John Stine, DNR.
