GOODRICH
CiTY ATTORNEY
April 5, 1988
City of R amsey Planning & Zoning Commission
William K. Goodrich, City Attorney
Subj: Conditional Use Permit Request of Jeff Erickson,
15270 S Francis Bivd.
It is my understanding that Jeff Erickson has applied for a
conditional use permit to construct and operate an office and
warehouse for an electrical contracting business at 15270 St.
Francis Blvd.
As you know, the subject property is in the C ity's B -1 zoning
district. In addition, a pre- existing residential home is al-
ready located on the property, which prior to this time, was
the principal use of the property. In addition, in 1987 Mr.
Erickson applied for a variance to allow for the construction
of an accessory building on his property which would have ex-
ceeded the height limitation permitted in a residential zone.
It is my understanding that Mr. Erickson wants the parcel to
remain B -1 and operate a business from the premises as well
as live on the site. In addition, Anne Norris advises me that
the City would like to keep the property in its present B -
zone.
It is my opinion that Mr. Erickson's plan is workable. I suggest
that because of Mr. Erickson's continued interest in using
his- property as commercial, and, of course, because it is zoned
commercial (B -1), that the residential use be considered non -con
forming, with the goal of some day, consistent with the City's
non - conforming use regulation, Section 170.015H, of phasing
out the residential use.
If the Commissioners and Mr. Erickson accep this reasoning,
which I believe to be the best characterization of the subject
property under our zoning ordinance, then Mr. Erickson will
not be required to obtain a conditional use permit. He will,
however, be req uired to obtain a site plan permit as required
by Section 170.017E of the zoning ordinance.
