<br />~~O.24 ~~ISANCES DECLARED. <br /> <br />The following are declared to be public nuisances whenever <br />and wherever they may be found within the designated Dutch elm <br />disease a~d/or oak wilt control areas within the city: <br /> <br />a. Any standing or living tree or part thereof infected to <br />any degree with the Dutch elm disease fungus, <br />ceratocvstis ulmi (Busiman) Moreau, or which harbors <br />any of the elm bark beetles, Scol vtus mul tistriatus <br />(Eichh) or Hvluraoninus rufipes (Marsch) . And also, <br />any dead elm tree or part thereof with bark intact <br />including logs, branches, stumps or firewood which has <br />root been disposed of proper~y. <br /> <br />b. Any living or standing tree or part thereof in th~ red <br />oak group (red oak, pin oak, scarlet oak, black oak) <br />infected to any degree with the oak wilt fungus, <br />ceratocvstis facracea~um (Bretz) Hunt. <br /> <br />c. Also, any living or standing tree in the white oak <br />group (white oak, bur oak, bicolor oak) that poses a <br />threat of transmission of the oak wilt fungus to other <br />trees of the same species through interconnected root <br />syster.s. <br /> <br />~~0.25 ABAT~~NT. <br /> <br />It is unla~ful for any ~arson to permit a public nuisance as <br />defined in 110.24 to remain on any premises owned or contr~lled <br />bv tha~ person within the desicnated control areas of the citv. <br />Such n\:.isances ..,ay be abated in the manner prescribed by this <br />Chapter. <br /> <br />~~0.26 INSPECTION AND Ih~STIGATION. <br /> <br />a.
