<br />DRAFT <br /> <br />Anoka County Contract No. 2006- <br /> <br />REVISED <br />JOINT POWERS AGREEMENT <br />FOR RIGHT -OF- WAY ACQUISITION <br />FOR THE FUTURE <br />: NORTHWEST METRO CORRIDOR AND RIVER CROSSING <br />OF THE MISSISSIPPI RIVER AT TH 10 <br />AND COUNTY STATE AID HIGHWAY 83 (ARMSTRONG BOULEVARD) <br /> <br />THIS AGREEMENT is made and entered into this _ day of , 2006 by and <br />between the County of Anoka, a political subdivision of the State of Minnesota, 2100 Third Avenue, Anoka, <br />Minnesota 55303, hereinafter referred to as "County", and the City of Ramsey, a municipal corporation <br />under the laws of the State of Minnesota, 15153 Nowthen Boulevard, Ramsey, Minnesota 55303, <br />hereinafter referred to as the "City". <br /> <br />WITNESSETH <br /> <br />WHEREAS, the County and the City agree that it is in the best interest of the public to provide plans <br />for geometric and capacity improvements for a future interchange for the Northwest Metro Corridor and <br />Mississippi River Crossing at TH 10 and CSAH 83 (Armstrong Boulevard) ("Interchange"); and, <br /> <br />WHEREAS, the County and the City also agree that it is in the best interest of the public to secure ,- <br />. the necessary right of way for the construction of the Interchange when it becomes available; and <br /> <br />WHEREAS, real property identified as PIN Nos. 29-32-25-21-0002 and 29-32-25-24-0001, which are <br />legally described in Exhibit A, which is attached hereto, is needed for the construction of the Interchange and <br />is available for purchase (" Interchange Property"); and, <br /> <br />WHEREAS, the City and County agree that it is in the best interest of the public to purchase the <br />Interchange Property at this time and to share in the cost of the acquisition as hereinafter provided; and <br /> <br />WHEREAS, Minn. Stat. ~ 471.59 authorizes political subdivisions of the state to enter into joint <br />powers agreements for the joint exercise of powers common to each. <br /> <br />NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED: <br />L PURPOSE <br /> <br />The parties have joined together for the purpose of purchasing the Interchange Property and sharing <br />the cost of acquisition as hereinafter provided. <br /> <br />II.
