Councilmember introduced the following resolution and moved for its <br />adoption: <br />RESOLUTION #06 -08- <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO THE <br />REQUEST FOR AN INTERIM USE PERMIT TO ALLOW THE CONSTRUCTION OF <br />A DRIVE -THRU IN THE TOWN CENTER -CORE AREA DISTRICT <br />WHEREAS, Sharp and Associates, hereinafter referred to as "Applicant ", has properly <br />applied to the City of Ramsey (the "City ") for an interim use permit to construct and operate a <br />drive -thru, menu board, and pick -up window at the property located at 7333 Sunwood Drive, <br />whose legal description is; <br />Lot 1, Block 1 Ramsey Town Center 11 Addition <br />(the "Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on August 3, 2006, and that the public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by. reference. <br />2. That the Subject Property is zoned TC -1, Town Center Core Area; <br />3. That the intent of the TC -1 District is to provide a mix of uses, to contribute to an active <br />pedestrian experience, and to maximize the use of land; <br />4. That the TC -1 District does not allow drive - thrust <br />5. That the Applicant is proposing to construct a drive aisle, menu board, and pick -up window <br />in the rear (north side) of the Ramsey Office Plaza to accommodate the needs of a coffee <br />shop; <br />6. That the City is requiring mitigating measures by the applicant regarding the installation of <br />landscaping and fencing to preserve the pedestrian orientation of the Town Center; <br />7. That Section 9.03.04A of City Code allows for an Interim Use Permit to be granted for a <br />maximum of five years, renewable indefinitely; <br />8. That the propose use will be in conflict with the intent of the zoning district; <br />9. That the proposed use will adversely impact traffic in the area; <br />10. That the proposed use will not be dangerous or detrimental to persons residing or working in <br />the vicinity of the use or to the public welfare; <br />11. That the proposed use will not substantially or adversely impair the use, enjoyment or market <br />value of surrounding properties. <br />
