• Eliminate the definitions of `boulevard', which is defined in the general <br />definitions section of Chapter 9, and Zoning Buffer, which is synonymous with <br />density transitioning. <br />• Define Certified Forester. <br />• Eliminate the requirement of biodegradable tree tubes for new plantings. <br />• Clarify the replacement requirements of the Tree Preservation Tree Density <br />Standard Calculation for multi - family developments, which will now require trees <br />to be replaced, on a one to one basis, if more than sixty percent (60%) of the DBH <br />inches of desirable trees on a site are removed. <br />• Eliminate the language concerning a developer's responsibility to maintain <br />plantings for one year after installation. In single - family developments, many <br />times the trees ultimately are installed by a builder or the homeowner, and in <br />multi- family developments, the development agreement requires the developer to <br />maintain plantings for a two -year period. <br />• Reference the vision clearance triangle in lieu of specifying a certain planting <br />distance from intersections. <br />• Eliminate the language discussing green, uncovered elm or pine wood and the <br />language concerning trees infected with Dutch Elm Disease or Oak Wilt as this is <br />addressed in Chapter 5 of City Code. <br />The Planning Commission held a public hearing and reviewed the proposed ordinance on <br />July 10, 2006, and there were no verbal or written comments submitted. The City <br />Council introduced the ordinance on July 25, 2006 and it is now eligible for adoption. <br />Recommendation: <br />The Planning Commission and the EPB recommend adoption of this ordinance. <br />Council Action: <br />Motion by and seconded by to adopt the <br />proposed ordinance amending City Code Section 9.24 (Tree Preservation <br />CC 8.8.06 <br />Roll Call Vote: <br />Review Checklist: <br />Asst.
