<br />The assessment procedures allow the opportunity for property owners being assessed a <br />period of 30 days beyond the date ofthe assessment hearing to appeal the assessment to <br />District Court. While the assessment hearing is typically conducted after the project is <br />completed or substantially completed, it is possible to hold the hearing prior to award to <br />determine whether any substantial assessment challenges will be made by the property <br />owners. <br /> <br />If there are no challenges to these proposed assessments it would be anticipated to award <br />this project on September 14, 2006 at a special City Council meeting. A notice to proceed <br />would be issued to the contractor on or about September 20, 2006. The contractor has <br />entered into a change order which allows 20 working days for the completion of this <br />project which would place the completion date on or about October 13, 2006. <br /> <br />Recommendation: <br /> <br />Following the close ofthe public hearing staff recommends that the City Council adopt a <br />resolution levying special assessments for Improvement Projects 06-04, 06-05, 06-06, 06- <br />07, 06-08, 06-09, and 06-11. <br /> <br />Action: <br /> <br />Motion to adopt Resolutions 06-08-XXX through 06-08-XXX levying special <br />assessments for Improvement Project 06-04,06-05,06-06,06-07,06-08,06-09, <br />and 06-11. <br /> <br />Reviewed By: <br />Public Works Director/Principal Engineer <br />City Attorney <br />Fire Chief <br /> <br />cc: 08/14/06 <br /> <br />10 <br />
