Mr. Way indicated staff <br />would like to explore alternatives to the Anoka facility, including creating a facility that can be <br />utilized by neighboring communities. They have started communications with the City of Elk <br />River on the feasibility of building ajoint impound facility. He has been in contact with the City <br />of Coon Rapids, and they are very interested in participating in a facility. <br /> <br />City Administrator Norman indicated the purpose tonight is to receive direction from Council on <br />whether staff should continue with discussions with the City of Elk River regarding creating an <br />animal containment facility. <br /> <br />Consensus of the Council was to direct staff to proceed in discussions with the City of Elk River <br />regarding creating an animal containment facility. <br /> <br />Further discussion: Councilmember Cook inquired if the same type of situation could occur if <br />the building were to be located in the City of Elk River, as the current situation in Anoka. City <br />Administrator Norman replied this would not be the situation because a joint powers agreement <br />would be entered into. Councilmember Strommen asked if adoption would be an option for the <br />strays. Police Chief Way responded in the affirmative. <br /> <br />4) Nuisance Ordinance/Administrative Penalties <br /> <br />City Administrator Norman explained that over the years, the City of Ramsey has considered <br />adopting "Administrative Penalties" as a system of citations and fines imposed and administered <br />by the City for violation of local ordinances. More specifically, the process could be used by <br />administration of nuisance ordinances. The topic recently came up at a Council meeting, and <br />staff was directed to place the item on a Council work session for discussion. Included in the <br />Council's packet is a memo dated September 2002, providing an overview of administrative <br />hearing procedures in the cities of Blaine and Coon Rapids. Mr. Norman advised the first bullet <br />point of this memo outlines disadvantages to the current Criminal Justice System for nuisance <br />ordinance violations: (a) The delay in the system did not ensure prompt resolution (b) Citizens <br />resented being labeled as criminals for violations of administrative regulations (c) The higher <br />burden of proof and potential incarceration did not appear appropriate for most administrative <br />violations (d) The criminal system did not always regard City ordinance violations as important <br />(e) The criminal system required citizens to take time off from work to appear at court. <br /> <br />City Administrator Norman indicated he would like direction from Council as to whether to <br />include this topic on a future agenda when staffhas received further information. <br /> <br />Consensus of the Council was to direct staff to include the topic of administrative penalties for <br />nuisance ordinances on a future agenda. <br /> <br />1) Highway 10 Leases <br /> <br />City Administrator Norman indicated prior to the discussion of Highway 10 leases he would like <br />to provide Council with an update regarding a meeting with Mr. Boike, Mr. Boike's attorney, <br />John Olson of Anoka County, Al Tinklenberg of The Tinklenberg Group, and himself. <br /> <br />City Council Work Session / July 18,2006 <br />Page 2 of 6 <br />
