<br />Councilmember Cook suggested the policy be rewritten to reflect what is being done with the <br />110% project costs. He commented if Council is willing to pay the difference they should be <br />able to go forward with the projects, rather than wait another year. <br /> <br />City Attorney Goodrich explained the 10% requirement used to be included in the City Charter, <br />and is now included in City Code. It is not the assessment amount that cannot be exceeded by <br />10%, it is the bid amount. An ordinance will be introduced to appeal this requirement at the next <br />Council meeting. <br /> <br />Councilmember Elvig suggested the contractor be asked if they would be willing to reduce the <br />bid by 2.4% because the project is injeopardy of being overturned by petition. <br /> <br />Mayor Gamec noted all of the bidders would need to be given the same opportunity to reduce <br />their bid by 2.4%. <br /> <br />City Attorney Goodrich indicated staff can ask the bidders for the reduction in the bid price as <br />suggested. <br /> <br />Dell Howe, 16471 Sapphire Street, stated part of the problem he sees is the tight timeframe. 11 <br />of the 19 properties are represented tonight, and they would like to know if they can authorize <br />the City to proceed with the project based on the numbers that have been presented and the <br />Council's plans to proceed at the 110% cost. <br /> <br />City Attorney Goodrich explained if a petition is received from 100% of the property owners in <br />support of the project the City would not need to wait the appeal time to proceed with the <br />project. <br /> <br />Councilmember Cook suggested Council proceed with the staff recommendation, as the public <br />hearing can be canceled if the property owners come in with the petition waiving any objections <br />on the project. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Cook, to adopt Resolution #06- <br />07-234 and Resolution #06-07-235 directing the preparation of the cost to be assessed in <br />accordance with the bids received, and setting a public hearing date of August 14, 2006 for the <br />assessment of the Improvement Project 05-27. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Jeffrey, Cook, Elvig, Olson, <br />Pearson, and Strommen. Voting No: None. <br /> <br />Case #6: <br /> <br />Award Bids for Salt Storage Building <br /> <br />City Engineer Jankowski reviewed that on December 13, 2005 City Council passed Resolution <br />#05-02-418 authorizing the solicitation of bids for construction of a salt storage building at the <br />Public Works campus at a cost not to exceed $165,000. Bids were opened on July 20,2006; one <br />bid was received from Greystone Construction in the amount of $133,000. Staff recommends <br /> <br />City Council / July 25, 2006 <br />Page 11 of20 <br />
