<br />Community Development Director Trudgeon stated in regards to item #3, the Planning <br />Commission and staff suggest utilizing the current R-2 open space standards for detached <br />townhomes. The proposed changes would limit the separation of buildings to a minimum of 10 <br />feet. It is also suggested that the City Council consider allowing detached townhomes in R-2 <br />districts without the use of a PUD rezoning. It is staff s opinion that incorporating detached <br />townhomes into the R-2 district will eliminate the need to use a PUD. Mr. Trudgeon advised in <br />regards to item #4, there are three ways to approach adding more "space" between units. One is <br />to redefine the open space requirements or increase the amount of open space requirements by <br />allowing for more condensed living quarters, but including more specific provisions for <br />community space. Currently, City Code requires 40% general open space (as defined by non- <br />impervious surface), 10% of which must be identifiable common area for use by residents. The <br />second option for increasing space between units is to increase private lot size, and the final <br />option is to require an established distance between buildings. <br /> <br />Councilmember Jeffrey questioned if the requirements related to Homeowners' Associations <br />require the Association to enforce City regulations. <br /> <br />Community Development Director Trudgeon responded in the negative. He explained the <br />Association is responsible for enforcing covenants of the Association; staff will review this to be <br />certain it is clear. <br /> <br />Councilmember Cook inquired about detached townhomes being allowed without PUDs with <br />setbacks being met. <br /> <br />Community Development Director Trudgeon explained if detached townhomes are made a <br />permitted use in R-2 districts they should be able to proceed without a PUD. If there is a need <br />for setback changes, that would be a variance request that would be considered by the Board of <br />Adjustment. There have been a lot of PUDs coming forward, and it would be preferred to <br />classify these detached townhomes as permitted uses. <br /> <br />Council and staff discussed setback and open space requirements, and whether detached <br />townhomes should continue being approved under PUDs, which would allow individual <br />consideration of each development in relation to community space and setbacks. <br /> <br />Councilmember Olson commented she agrees with not singling out any particular style of <br />housing to force into a PUD situation. However, the City has not dealt with many of these <br />detached townhomes and they got in quite a bind with the cluster developments with the solid <br />rules that were set. She believes the detached townhomes should be dealt with through PUDs <br />until it is seen how they play out. <br /> <br />Community Development Director Trudgeon indicated staff will review the options and bring <br />back items for consideration. The item tonight is introduction of the ordinance; if it is <br />determined to proceed under PUDs it will require a major rewrite of the ordinance. <br /> <br />Mayor Gamec requested staffs recommendation on whether to proceed under PUDs. <br /> <br />City Council / July 25, 2006 <br />Page 13 of 20 <br />
