<br />Community Development Director Trudgeon stated the developer has complied with the August <br />2,2005 Review Letter. The trail alignments have been agreed to by City staff and the developer. <br />On October 6, 2005, the Board of Adjustment granted a variance to the front yard setback on <br />certain lots. On June 13,2006, City Council granted the developer permission to apply for final <br />plat approval prior to receiving the MPCA Certificate of Completion for site clean-up, noting <br />that preliminary and final plat approvals still remain to be contingent upon receiving that permit. <br />This Certificate is expected to be completed in the next couple of weeks. The installation of the <br />fire hydrant is a requirement of Phase 3 of the development. <br /> <br />Community Development Director Trudgeon explained access from this first phase is provided <br />onto Variolite Street at two locations: 163rd Avenue NW and 1615t Avenue NW. There are <br />delineated wetlands in this first phase that are proposed to be encumbered with drainage and <br />utility easements. Also, this first phase requires filling 0.19 acres of wetland to facilitate <br />construction of 163rd Avenue. The developer has obtained the proper permit from the Lower <br />Rum River Water Management Organization. Although the wetland buffer ordinance was <br />pending at the time of preliminary plat review, the developer is providing a wetland buffer that <br />ranges in width from 5 to 25 feet. The limits of the buffer will be signed. Mr. Trudgeon advised <br />park dedication will consist of a cash payment. The developer will be responsible for the <br />construction of a trail adjacent to Variolite Street NW from the north boundary of the plat, south <br />to 1615t Avenue NW. There is a trail corridor under development from Elmcrest Park to Central <br />Park. The developer will also construct the segment of that trail corridor that lies within the <br />boundaries of this plat, including the boardwalk east of the southeast boundary of the plat. The <br />developer must provide the City with written approvals for that boardwalk from DNR and the <br />landowner. A tree preservation and landscape plan have been provided and reviewed. Minor <br />modifications to the landscape plan are recommended. Mr. Trudgeon advised staff recommends <br />final plat approval with the following conditions: <br />a) Compliance with City Staff Review Letter dated July 21,2006 <br />b) Obtaining a Certificate of Completion form MCP A for site clean-up, which also <br />remains as a contingency to preliminary plat approval. <br /> <br />Councilmember Strommen requested the Council be notified through the Weekly Update when <br />the Certificate of Completion is obtained. <br /> <br />Councilmember Elvig indicated he will be abstaining from the vote on this case. <br /> <br />Motion by Councilmember Pearson, seconded by Councilmember Cook, to adopt Resolution <br />#06-07-217 granting final plat approval to Sweetbay Ridge contingent upon the following <br />conditions: <br />a) Compliance with City Staff Review Letter dated July 21,2006 <br />b) Obtaining a Certificate of Completion form MCP A for site clean-up, which also <br />remains as a contingency to preliminary plat approval. <br /> <br />Motion carried. V oting Yes: Mayor Gamec, Councilmembers Pearson, Cook, Jeffrey, Olson, <br />and Strommen. Voting No: None.
