<br />has received agreement from the low bidder on the contract, Bauerly Brothers, to hold their bid <br />price. They would agree to shorten the amount of working days to fulfill the contract from 45 to <br />20. The cutoff date for bituminous spreading would normally be around October 15, but it can <br />be done under weather conditions of 50 degrees. Staff feels the work should be able to be <br />accomplished by adhering to the proposed schedule. The contractor has indicated he would need <br />to have assurance that if for no reason of his own, such as due to weather, that those days would <br />not count as a working day. In that type of situation he would be given a change order for higher <br />prices for any bituminous that would need to be placed next spring. <br /> <br />Councilmember Olson asked when the work would begin. <br /> <br />City Engineer Jankowski replied it is anticipated work would begin September 20. Thirty days <br />after the assessment hearing when any challenges would expire they could safely order the <br />project and be assured there would not be a problem if there were a challenge to the assessments. <br />There would be a special session to award this portion of the contract. <br /> <br />Councilmember Olson inquired what the situation would be if there were a challenge to the <br />assessments. <br /> <br />City Engineer Jankowski replied if there were to be a challenge the entire assessment could be <br />lost. <br /> <br />Councilmember Cook stated the City does not have any choice but to make every effort to go <br />forward with this project. Council needs to seriously look at the 2007 budget and the funds <br />available to accomplish these road improvements. <br /> <br />Mayor Gamec expressed concern that 160th Lane is in such bad shape; if it goes another year it <br />will require a total replacement, which will raise the prices at least double. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Olson, to: <br />· Direct that Project 06-10 be eliminated from the 2006 Street Program. <br />· Adopt Resolutions #06-07-218, #06-07-219, #06-07-220, #06-07-221, #06-07-222, #06- <br />07-223 and #06-07-224 declaring the costs to be assessed for IP's 06-04, 05, 06, 07, 08, <br />09 and 11 at 110% of those identified in the feasibility study and adopt Resolutions #07- <br />06-225, #06-07-226, #06-07-228, #06-07-227, #06-07-228, #06-07-229, #06-07-230, and <br />#06-07-231 that an assessment hearing on said assessment be set for a special meeting <br />Monday August 14, 2006. <br />· Direct staff to construct the TH 47 trail project with City forces. <br />· Adopt Resolution #06-07-232 awarding of Division B, schedule B in the amount of <br />$419,172.18 and Division C, Schedule B in the amount of $74,167.66 be awarded to <br />Bauerly Brothers, the low responsible bidder. <br /> <br />Motion carried.
