Absent: Commissioners Mam and Spain <br />Brist. <br /> <br />COMMISSION BUSINESS <br /> <br />Case #1: Charter Amendment Issues Regarding Plats Approved Since January 1, 1997 <br /> <br />Chairperson Peterson summarized developments from the October 14, 1997 City Council <br />meeting, regarding the September 22, 1997 Charter Amendment. City Attorney Goodrich had <br />advised the Council that in his opinion the amendment cannot apply retroactively to plats that <br />had recei ved preliminary or final approval before the amendment was adopted. <br /> <br />Commissioner Kiefer presented language that might be recommended to Council to amend the <br />Charter Amendment. (See Exhibit A). <br /> <br />Discussion ensued as to whether to clear up the ambiguity in the new amendment or to leave the <br />language as is and let the courts handle the amendment if it is brought before them. <br /> <br />Motion by Commissioner Swokowski and seconded by Commissioner Kiefer to send language <br />changes to the Charter Amendment to Attorney Goodrich for comment from him and then have a <br />discussion to go forward or leave it alone. <br /> <br />Motion failed. Voting Yes: Chairperson Peterson, Commissioners Kiefer and Swokowski. <br />Voting No: Commissioners Anderson, Donovan, Netzloff and Vogt. Absent: Commissioners <br />Mam and Spain Brist. <br /> <br />Motion by Commissioner Donovan and seconded by Chairperson Peterson to allow the <br />Comprehensive Plan and the legal process to sort out the current Charter Amendment. <br /> <br />Motion carried. Voting Yes: Chairperson Peterson, Commissioners Anderson, Donovan, <br />Netzlof( Swokowski and Vogt. Voting No: None Abstaining: Commissioner Kiefer. Absent: <br />Commissioners Mam and Spain Brist. <br /> <br />Case #2: Possible Charter Changes <br /> <br />Discussion ensued as to what ability the Commission has to change the Charter.
