Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #06 -08- A RESOLUTION, APPROVING THE ISSUANCE OF A HOME OCCUPATION PERMIT TO ESTABLISH AN IN -HOME FAMILY -RUN WHOLESALE BAKERY ON THE PROPERTY LOCATED AT 5560 144 AVENUE NW BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT WHEREAS, the Ramsey City Council adopted Resolution #06 -08 - adopting Findings of Fact # for this use and herein approves the Home Occupation Permit. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On August 22, 2006 a Home Occupation Permit ( "Permit ") was issued by the City of Ramsey ( "City ") to Scott Johnson and Nhu Tran ( "Permit Holder ") for a home occupation to establish a family -run wholesale bakery in the basement of the dwelling on the property generally known as 5560 144 Avenue NW and legally described as follows: Lot 18, Block 4, The Ponds of Ramsey, Anoka County, Minnesota ( "Subject Property") This permit is issued pursuant to Section 9.03.05 and 9.11.04 of the Ramsey City Code. The conditions of this permit are as follows: 1. That this resolution shall allow for the establishment and operation of a family -run wholesale bakery in the basement of the dwelling on the Subject Property. 2. Should the Permit Holder die or move to a new location, the Permit shall be automatically terminated, except that in the case of death, should a surviving spouse or child, residing at the same address, desire to continue the home occupation, written notice to that effect shall be given to the City Administrator and the City Council may authorize continuation of the Permit without further hearing. 3 The area devoted to the home occupation shall not exceed twenty percent (20 %) of the total floor area of the private dwelling. 4. Adequate water supply and sewage disposal facilities shall be the responsibility of the Permit Holder. 5 There shall be no business signs visible from the exterior of the home. 6. There shall be no exterior indications of the home occupation displayed.
