~

..

CASE #: I

REQUEST FOR A CONDITIONAL USE PERMIT
TO GRADE AND EXPORT SOILS; CASE OF THOMAS KURAK
By: Zoning Administrator Sylvia Frolik

Background:

On April 1, 1997, the Planning Commission conducted a public hearing hearing
regarding Mr. Kurak's request for a conditional use permit to grade and export soils from
his property at 15001 Sunfish Lake Blvd. N.W. At that time Staff reported a number of
deficiencies in the application submittals and the Commission tabled action on the
request and continued the public hearing to the regular meeting in May.

At the May 6 Planning Commission meeting, it was reported that the requested
information had not been provided and Mr. Kurak's surveyor estimated that the materials
wouldn't be ready until mid-May. The Planning Commission tabled action on the request
and continued the public hearing until the regular meeting in June.

Observations:

At the date of this writing, the requested application submittals still had not been received
at the City.

Recommendation:

City Staff recommends adjournment of tonight's public hearing and rescheduling the
public hearing and Commission action when the requested application submittals have
been provided.

Commission Action:

Motion to:
Table action on Mr. Kurak's request for a conditional use permit to grade and
export soils until the additional information required with the application
submittal has been provided to the City.

Review Checklist:

City Engineer

PC: 6/3/97

I
