<br />-) <br /> <br />Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION NO. 97-07-_ <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT #_ AND DECLARING TERMS OF PERMIT TO <br />GRADE AND EXPORT SOILS <br /> <br />WHEREAS, the Ramsey City Council adopted Resolution No. 97-07-_ adopting Findings <br />of Fact # _ for this use and herein approves the Conditional Use Permit subject to the following <br />conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On July _, 1997 a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to <br />Thomas Kurak ("Permit Holder") for grading operations on the property legally described as follows: <br /> <br />The Southeast Quarter of the Southwest Quarter, Section 23, Township 32, Range 25, Anoka <br />County, Minnesota. Together with that part of Government Lot 1 of said Section 23 lying <br />easterly of the easterly line of the right-of-way of County Road No. 57, also known as <br />Sunfish Lake Boulevard, according to the duly recorded plat of ANOKA COUNTY <br />HIGHWAY RlGHT-OF-WAY PLAT NO. 1. Excepting from said Government Lot 1 all that <br />part thereof described as commencing at a point on the south line of said Government Lot 1 a <br />distance of 572.00 feet East of the southwest comer thereof; thence North 15 degrees 51 <br />minutes 08 seconds East for 741.00 feet to a point to be hereafter known as Point "G" for the <br />purposes of this description; thence South 89 degrees 21 minutes 08 seconds West parallel <br />with said south line of Government Lot 1 for about 65.73 feet to intersect with the above <br />described easterly line of right-of-way of County Road No. 57, said point of intersection also <br />being the actual point of beginning of the exception to be hereby described; thence return <br />East to said Point "G"; thence South 26 degrees 38 minutes 52 seconds East for 366.00 feet; <br />thence South 3 degrees 08 minutes 52 seconds East for about 381.89 feet to intersect said <br />south line of Government Lot 1; thence South 89 degrees 21 minutes 08 seconds West along <br />said south line of Government Lot 1 for about 646.17 feet to intersect with the above <br />described easterly line of the right-of-way of County Road No. 57; thence northeasterly along <br />said easterly line of the right-of-way of County Road No. 57 for about 856.05 feet to the <br />point of beginning. For the purposes of this exception description, said south line of <br />Government Lot 1 is assumed to bear North 89 degrees 21 minutes 08 seconds East. <br /> <br />("Subject Property:") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code.
