<br />( <br /> <br />CASE #: / <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT <br />TO GRADE AND EXPORT SOILS; CASE OF THOMAS KURAK <br />By: City Engineer Steve Jankowski <br /> <br />Background: <br /> <br />On March 11, 1997, Mr. Thomas Kurak submitted an application to the City for a conditional use <br />permit to grade and export approximately 100,000 yards of soil from his property at 15001 <br />Sunfish Lake Blvd. <br /> <br />On April 1, 1997, the Planning Commission conducted a public hearing and City Staff reported a <br />number of deficiencies in the application submittals. The City Attorney also reported that in his <br />opinion, the size of the proposed project required an environmental assessment worksheet. The <br />Commission tabled action on the request and continued the public hearing to the regular meeting <br />in May. <br /> <br />At the May 6 Planning Commission meeting, it was reported that the requested information had <br />not been provided the Planning Commission. tabled action on the request and continued the <br />public hearing until the regular meeting in June. <br /> <br />On June 3 the Planning Commission ruled that the public hearing would reconvene on July 1 and <br />that some type of action would be taken on Mr. Kurak's request based on the materials that have <br />been provided to the City. <br /> <br />The following items are enclosed: <br /> <br />a) Site location map <br />b) Six sheet set of plans submitted by the Applicant <br />c) Letter from Anoka County dated March 25, 1997 <br />d) Letters received from area residents to date <br />e) April 1, 1997 Planning Commission public hearing minutes <br />f) Proposed findings of fact <br />g) Proposed conditional use permit <br /> <br />Notification: <br /> <br />Persons owning property within 700 feet of the subject property were notified of the April 1 <br />public hearing date. Those same persons were also notified by a mailing that the Planning <br />Commission would take action on the request on July 1. <br /> <br />I <br />
