<br />" <br /> <br />, ,- <br /> <br />(a) "Applicant" means any Person requesting permission to Excavate or Obstruct a Right-of- . <br />Way. <br /> <br />(b) "Business District" means that portion of the City lying within and bounded by the following <br />streets: (insert your City definition here) <br /> <br />(c) "City" means the City of Eagan, Minnesota. For purposes of Sections 1.15, City means its <br />elected officials, officers, employees and agents. <br /> <br />(d) "City Cost" means the direct and.indirect costs borne by the City for pavement management, <br />traffic management, risk management, financial management, cost recovery, infrastructure <br />oversight, budget analysis, record keeping, legal assistance, systems analysis, application <br />processing and checking, issuing Permits, inspecting job sites, creating and updating mapping <br />systems, and performing all of the other tasks required by Chapters 1 and 2, including other costs <br />the City may incur in managing the provisions of these ordinances. <br /> <br />(e) "Degradation" means the accelerated depreciation of the Right-of-Way caused by Excavation <br />in or disturbance of the Right-of- Way, resulting in the need to reconstruct such Right-of-Way <br />earlier than would be required if the Excavation did not occur. <br /> <br />(f) "Department" means the Department of Public Works of the City. <br /> <br />(g) "Department Inspector" means any Person authorized by the Director to carry out inspections <br />related to the provisions of Chapters 1 and 2. <br /> <br />(h) "Director"4 means the Director of the Department of Public Works of the City, or her or his <br />designee. <br /> <br />(i) "Disruptive Cost" is the adverse impact on City citizens and others who are required to alter <br />travel routes and times resulting from Right-of-Way Obstructions. <br /> <br />G) "Emergency" means a condition that (a) poses a clear and immediate danger to life or health, <br />or of a significant loss of property; or (b) requires immediate repair or replacement in order to <br />restore Service to a customer. <br /> <br />(k) "Equipment" means any tangible thing located in any Right-of-Way; but shall not include <br />boulevard p1antings or gardens planted or maintained in the Right-of-Way between a Person's <br />property and the street curb. <br /> <br />4This could be the City engineer, the street superintendent, or the City manager, or in <br />each case, his or her designee. Some cities prefer to designate the City manager as the <br />administrative authority in all cases, relying on the manager to make the appropriate assignment. <br /> <br />3 <br /> <br />57 <br />
