<br />(x) "Probation Period" means one (1) year from the date that a Person has been notified in
<br />writing that they have been put on Probation.
<br />
<br />(y) "Registrant" means any Person who (1) has or seeks to have its Equipment located in any
<br />Right-of-Way, or (2) in any way occupies or uses, or seeks to occupy or use, the Right-of-Way or
<br />any Equipment located in the Right-of-Way.
<br />
<br />(z) "Removal and Restoration Bond" means a bond or letter of credit posted to ensure the
<br />availability of sufficient funds to remove a Registrant's Equipment upon its possible
<br />abandonment or disuse, for whatever reason, or to discontinue a Registrant's use or occupation of
<br />the Right-of-Way, and to restore the Right-of-Way.
<br />
<br />(aa) "Restore" or "Restoration" me~s the process by which an Excavated or Obstructed Right-
<br />of- Way is returned to a condition which approximates as closely as possible its condition before
<br />the Excavation.
<br />
<br />(bb) "Restoration Fee" means an amount of money paid to the City by a Permittee to cover the
<br />cost of Restoration.
<br />
<br />(cc) "Right" is the legal entitlement ofa Person to use the Right-of-Way in the City for the
<br />purposes of carrying on its business. A right for the purpose of these Chapters does not include,
<br />and does not refer to, a license, Permitpr franchise. Right shall not include the use of the Right-
<br />of-Way for purposes not in furtherance of the furnishing of Utility Services, unless the Person
<br />pays the user fee for such Non-Utility Service use.
<br />
<br />(dd) "Right-of-Way" means the surface and space above and below any real property in which
<br />the City has an interest in law or equity, whether held in fee, or other estate or interest, or as a
<br />trustee for the public, including, but not limited to any public street, boulevard, road, highway,
<br />freeway, lane, alley, court, sidewalk, parkway, river, tunnel, viaduct, bridge, park, skyway,
<br />skyway bridge or any other place, area, or real property owned by or under the control of the
<br />City, or in which the City has such an interest. . . .
<br />
<br />(ee) "Right-of- Way Permit" means either the Excavation Permit or the Obstruction Permit, or
<br />both, depending on the context, required by Chapters 1 and 2.
<br />
<br />(ft) "Service" or "Utility Service" includes (i) those Services provided by a public utility as
<br />defined in Minn. Stat. ~ 216B.02. subds. 4 and 6 (1994), (ii) telegraph, telephone,
<br />telecommunications, fiber-optic communications, pipeline, community antenna television, cable
<br />communications, fire and alarm communications, water, electricity, light, heat, cooling energy,
<br />or power Services, (iii) the Services provided by a corporation organized for the purposes set for
<br />in Minn. Stat. ~ 300.03 (1994); and (iv) the Services provided by a district heating or cooling
<br />system.
