<br />Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />PROPOSED RESOLUTION #97- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT FOR THE CONSTRUCTION AND OPERATION OF A PERSONAL <br />COMMUNICATION SERVICE (PCS) TOWER AND <br />DECLARING TERMS OF SAME <br /> <br />WHEREAS, AMERICAN PORTABLE TELECOM (APT) has properly applied <br />for a conditional use permit to construct and operate a telecommunications tower on a 50' <br />x 50' section (site) of the property legally described as follows: <br /> <br />The north 426.29 feet as measured along the West Line of that part of the <br />Southwestern Quarter of the Southeastern Quarter of Section 11, Township 32, Range 25, <br />Anoka County, Minnesota, lying westerly of the centerline of State Highway No. 47 <br />(subject to road and highway easements over the north and east 33 feet). <br /> <br />("Subj ect Property") <br /> <br />WHEREAS, the Planning Commission met on August 5, 1997, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as <br />follows: <br /> <br />1. Based on Findings of Fact , a conditional use permit for a 50 meter <br />(approximately 165 feet) monopole and related equip~ent cabinets is hereby <br />granted to APT and Rum River Plaza Associates, hereinafter referred to as <br />"Permit Holder". <br /> <br />2. This permit is perpetual in its duration so long as the terms imposed herein are <br />complied with. <br /> <br />3. The development of the Site shall be in accordance with the 4 sheet site plan <br />prepared by Fluor Daniel, Inc., dated July 11, 1997, 'and the written support <br />materials prepared by Michelle R. Johnson, Zoning Coordinator, Cellular Realty <br />Advisors, Inc., on behalf of APT, dated July 9, 1997. <br /> <br />4. Prior to the issuance of a building permit for the tower, the Permit Holder shall <br />supply the City with affirmation that the proposed tower will comply with any <br />applicable regulations administered by the Federal Aviation Administration and a <br /> <br />77 <br />
