<br />,. - <br /> <br />. . <br /> <br />CASE # I <br /> <br />REQUEST FOR A CONDITIONAL USE PERMlT FOR A METAL ACCESSORY <br />BUILDING ON LESS THAN 2.5 ACRES; CASE OF SCOTT AND LORI JONES <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On September 16, 1997, the City received an application from Scott and Lori Jones for a <br />conditional use permit to construct a metal accessory building on less than 2.5 acres on their <br />property at 16000 St. Francis Blvd. N.W. The following items are enclosed for your <br />information: <br /> <br />a) Site location map <br />b) Site Plan and text <br />c) Letter of support <br />d) Proposed findings of fact <br />e) Proposed conditional use permit <br /> <br />Notification: <br /> <br />Conditional Use Permits are required to be subjected to public hearings and all properties within <br />350 feet of the subject property are to be notified. Staff attempted to notify property owners <br />within 500 feet of the subject property. <br /> <br />Observations: <br /> <br />City Code establishes a threshold of 2.5 acres in order for residential property owners to have the <br />metal pole bam type accessory buildings. Scott and Lori's property is 1.7 acres in size. When <br />they purchased the parcel they were told that the property was 2.5 acres in size and qualified for a <br />pole barn. The Jones did sue and the courts determined that they were wronged. In any event, <br />. the Jones have applied for a conditional use permit for a metal accessory building on less than <br />2.5 acres. The City has granted similar permits in the past for the storage of personal equipment <br />and vehicles when there is a sufficient amount of natural screening existing on the property. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the request based on the natural screening in place. <br /> <br />Commission Action: <br /> <br />Motion to recommend that City Council adopt Findings of Fact relating to Scott and Lori Jones' <br />request for a conditional use permit. <br /> <br />-and- <br /> <br />Motion to recommend that City Council approve/deny Scott and Lori Jones' request for a <br />conditional use permit for a metal accessory building on less than 2.5 acres. <br /> <br />PC: <br /> <br />10/07/97 <br /> <br />I <br />
