" <br /> <br />CASE # ~ <br /> <br />REQUEST TO REZONE CERTAIN PROPERTY FROM <br />B-1 BUSINESS TO B-2 BUSINESS AND R-3 URBAN RESIDENTIAL; <br />CASE OF RADEMACHER COMPANIES, INC. <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Rademacher Companies, Inc. is requesting approval to rezone property at the southeast corner of <br />the intersection of 153rd Avenue and T.R. #47 from B-1 Business to B-2 Business and R-3 <br />Urban Residential. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map showing proposed property split <br />b) Zoning Location Map and Zoning Exhibit <br />c) Concept plan for convenience store <br />d) Proposed findings of fact <br /> <br />Notification: <br /> <br />Staff went beyond the standard 350 foot distance requirement and attempted to notify all <br />property owners within 500 feet ofthe subject property. <br /> <br />Observations: <br /> <br />The applicant has also submitted a subdivision plan to split their property into two lots. The very <br />northwest corner of the property will be Lot 1 and it is currently zoned B-1 Business. The <br />applicant desires to develop this lot with a convenience store with gas sales. Gas sales requires a <br />B-2 zoning and the applicant has submitted an application for rezoning accordingly. The <br />remainder of the property will be platted as an outlot. Except for a small triangular piece in the <br />northwest corner of that outlot which is zoned B-1 Business, the property to be platted as the <br />outlot is zoned R-3 Urban Residential. The applicant has submitted an application to rezone that <br />triangular piece to the same R-3 zoning as the rest of Outlot A. <br /> <br />The City is currently under a development moratorium on residential land. Therefore, the <br />proposal to rezone what will be platted as Lot 1 from B-1 to B-2 Business can be acted upon. <br />Because of the moratorium, the rezoning of the triangular piece to R-3 Residential can go as far <br />as the first reading of the ordinance at the Council level. Final adoption of the ordinance will not <br />be possible until the moratorium expires in January of 1998. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval, of the proposed rezonings. <br /> <br />3, <br />
