<br />CASE # I <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO CONSTRUCT AN <br />ACCESSORY BUILDING ON A LOT PRIOR TO THE PRINCIPAL BUILDING; <br />CASE OF JUDY KUEMPER <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On October 14, 1997, the City received an application from Judy Kuemper for a conditional use <br />permit to construct an accessory building on a lot prior to there being a principal building or <br />dwelling on the property. The property is located on the south side of 151st Avenue N.W. in the <br />vicinity of Fluorine Street. The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site Plan <br />c) Letter received from Mrs. Audrey Ewert dated October 27, 1997 <br />d) Proposed findings of fact <br />e) Proposed conditional use permit <br /> <br />Notification: <br /> <br />Conditional Use Permits are required to be subjected to public hearings and all properties within <br />350 feet of the subject property are to be notified. Staff attempted to notify property owners <br />within 500 feet of the subject property. <br /> <br />Observations: <br /> <br />City Code states that no accessory building shall be constructed on a lot unless there is a <br />principal building (a home in this case) on the lot. However, Judy Kuemper owns and resides on <br />the adjacent parcel to the east. If she chose to, she could replat the property into one lot and she <br />would not need a conditional use permit for her proposed accessory building. <br /> <br />Ms. Kuemper indicates that the accessory building will be used for the storage of personal <br />vehicles and equipment only. The property, exclusive oflter homestead, is 3 acres in size and is <br />entitled to a total of 2,464 square feet of garage and accessory building space. The proposed <br />building is 1,536 square feet in size. <br /> <br />Between her two parcels, Ju<iy has enough frontage on 151st Avenue to create 4 urban lots on <br />151st Avenue, if and when sewer and water become available. However, she should understand <br />. that the placement of the accessory building and the location of her home may reduce her <br />subdivision potential to 3 lots on 151st. The building is being placed far enough back from 151st <br />so that it will not be in the front yard if and when resubdivision to urban standards occurs. <br /> <br />I <br />
