REQUEST FOR A HOME OCCUPATION PERMIT; CASE OF BARBARA NESLON Zoning Administrator Sylvia Frolik Background: On August 6. 1997, the City received an application from Barbara Nelson for a home occupation permit to establish a hair and nail salon in her home at 5211 155th Lane N.W. The following items are enclosed for your information: a) Site location map b) 5 sheet site plan set c) Petition from neighboring property owners d) Proposed findings of fact e) Proposed conditional use permit Notification: State statute requires notification of hearing to property owners within 350 feet of the subject property. Staff attempted to notify persons within 500 feet of the subject property. Observations: Barbara Nelson is proposing to construct an addition to the home on 155th Lane N.W. for the purpose of providing space for a home hair and nail salon. The room addition just meets the 20% restriction for area of home devoted to home occuation. Barbara "will be the sole employee and she expects to service approximately 30 clients per week. She is requesting hours of operation from 9:00 a.m. to 8:00 p.m., Monday through Friday. Barbara has provided a petition, signed by some of her neighbors, in support of her request for a home occupation permit. Several similar home occupation permits have been issued by the City in the past. Recommendation: City Staff recommends approval of the request. Commission Action: Motion to: Recommend that City Council adopt Findings of Fact relating to Barbara Nelson.s request for a conditional use permit. -and- Motion to; Recommend that City Council approve/deny Barbara Nelson's request for a home occupation permit.
