The Permit Holder agrees to permit access to the property by the <br />City to facilitate restoration, if necessary. <br /> <br />14. <br /> <br />The Permit Holder shall implement sediment and erosion control practices. No grading <br />activity shall occur within twenty-five (25) feet of a property line unless silt fence is placed <br />along the property Hne to prevent sediment from washing onto the adjoining property. Any <br />erosion which causes gullies of greater than one (1) foot within twenty-five (25) feet of a <br />property line shall be regraded within forty-eight (48) hours of the precipitation event that <br />caused the erosion. <br /> <br />15. <br /> <br />The stockpiling of excavated materials and brush piles shall be as shown on Exhibit A and <br />page 4 of the 'Information for Conditional Use Permit' submitted by the Permit Holder. <br /> <br />16. <br /> <br />The Permit Holder shall file with the City a liability insurance policy or certificate of such <br />insurance acceptable to the City and issued by an insurance company authorized to do <br />business in the State of Minnesota. <br /> <br />The policy shall insure the permit holder for the sum of at leaSt $300,000 for injury to one <br />person and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />Said policy shall be for the full period of the permit and shall provide for the giving of 10 <br />days prior notice to the City by registered mail of termination, cancellation or amendment of <br />the policy. <br /> <br />In the event said policy is terminated for any reason, the permit shall be automatically <br />suspended upon the day the policy terminates unless a new policy complying with this item <br />is. obtained and filed with the City prior to the termination of the policy in force. <br /> <br />The maximum noise level at the perimeter of the work site shall be within the limits set by <br />the Minnesota Pollution Control Agency and the Environmental Protection Agency of the <br />United States. <br /> <br />No materials, either brush or export topsoil material, shall be stockpiled within any utility. <br />easement or within 75 feet of any overhead power lines. <br /> <br />The brush stockpiles shall be covered with excavated material t~ hasten their decomposition. <br />Periodic vent holes shall be left in the cover to prevent anaerobic conditions from developing. <br />Brush stockpiles shall be limited to a height of 20 feet. <br /> <br />Silt fence shall be installed a minimum of 30 feet from the nearest edge of the County ditch <br />and no tree cleaning or excavation shall take place within this buffer. <br /> <br />RESOLUTION #97-07-179 <br />Page 4 of6 <br />
