Board Member adoption: introduced the following resolution and moved for its RESOLUTION #97-10--, A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING TERMS OF SAME. WHEREAS, L.A.N.D. Properties has properly applied for a variance from the height restrictions in the B-3 Highway Business District, Critical River Overlay District and Wild and Scenic Overlay District on the property legally described as follows: Lot 1, Block 1, RIVERVIEW ESTATES, Anoka County, State of Minnesota (the "Subject Property"); and WHEREAS, the Board of Adjustment met on October 21, 1997, conducted the public hearing and adopted fmdings of fact relating to the request for a variance from height restrictions. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows 1. Based on Findings of Fact # --' a variance to height restrictions is hereby granted. 2. The motel shall be allowed for development on the Subject Property with parapet walls no higher than 44i6" from grade. 3. The property owner shall obtain all necessary permits prior to commencing any construction. No building permit for the structures shall be released by the City of Ramsey without certification of the variance by the Department of Natural Resources in accordance with procedures established in Section 9.21.07 (Critical River Overlay District Development Standards) and Section 9.23.06 (Scenic River District Provisions) of the Ramsey City Code. 4. The property owner shall be responsible for all City costs incurred m administering and enforcing this variance.
