<br />Board Member <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #97-10--, <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND <br />DECLARING TERMS OF SAME. <br /> <br />WHEREAS, L.A.N.D. Properties has properly applied for a variance from the <br />height restrictions in the B-3 Highway Business District, Critical River Overlay District <br />and Wild and Scenic Overlay District on the property legally described as follows: <br /> <br />Lot 1, Block 1, RIVERVIEW ESTATES, Anoka County, State of Minnesota <br /> <br />(the "Subject Property"); and <br /> <br />WHEREAS, the Board of Adjustment met on October 21, 1997, conducted the <br />public hearing and adopted fmdings of fact relating to the request for a variance from <br />height restrictions. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows <br /> <br />1. Based on Findings of Fact # --' a variance to height restrictions is hereby <br />granted. <br /> <br />2. The motel shall be allowed for development on the Subject Property with parapet <br />walls no higher than 44i6" from grade. <br /> <br />3. The property owner shall obtain all necessary permits prior to commencing any <br />construction. No building permit for the structures shall be released by the City of <br />Ramsey without certification of the variance by the Department of Natural <br />Resources in accordance with procedures established in Section 9.21.07 (Critical <br />River Overlay District Development Standards) and Section 9.23.06 (Scenic <br />River District Provisions) of the Ramsey City Code. <br /> <br />4. The property owner shall be responsible for all City costs incurred m <br />administering and enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board <br />Member and upon vote being taken thereon, the following voted in favor <br />thereof: <br /> <br />10 <br />
