<br />CASE # I <br /> <br />REQUEST FOR A VARIANCE TO HEIGHT RESTRICTIONS; CASE OF <br />L.A.N.D. PROPERTIES <br />By: Zoning Administrator Sylvia FroIik <br /> <br />Background: <br /> <br />L.A.N.D. Properties has applied for site plan approval to construct a motel on Lot 1, <br />Block 1, Riverview Estates. The subject property is located in the B-3 Highway Business <br />District, the Critical River Overlay District, and the Wild and Scenic River Overlay <br />District, ~d as such the structure height is restricted to 35 feet. Section 9.20.23 <br />(permitted Encroachments) of City Code allows parapet walls to extend 4 feet into the 35 <br />foot height restriction. The design of the motel includes parapet walls, the highest of <br />which is 44'6" from grade, which is a 5'6" extension beyond the 39 foot restriction. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site Plan and building elevations <br />c) Proposed findings of fact <br />d) Proposed variance <br /> <br />Notification: <br /> <br />Property owners in excess of the 350 foot distance requirement were notified of the <br />public hearing. <br /> <br />Observations: <br /> <br />The main purpose of the 35 foot height restriction is based on the reach capabilities offrre <br />suppression equipment and to protect the natural view from the river. The subject <br />property is not visible from the Mississippi River and in addition, visibility of the hotel <br />would be obstructed by the river bank, homes and existing tree cover. The occupied <br />portion of the motel is within the 35 foot height restriction and does not present a <br />problem to the frre department. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the variance contingent upon DNR certification of <br />same. <br /> <br />I <br />
