<br />Board Member <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-10-_ <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #_ RELATING TO A <br />REQUEST FOR A VARIANCE TO THE HEIGHT RESTRICTIONS IN THE B-3 <br />BUSINESS DISTRICT AND THE CRITICAL AND WILD AND SCENIC RIVER <br />OVERLAY DISTRICTS <br /> <br />WHEREAS, L.A.N.D. Properties, Inc., hereinafter referred to as "Applicant", has <br />properly applied for a Board of Adjustment variance from structure height restrictions to <br />develop a 3-story motel with extended parapet walls on the property legally described as <br />follows: <br /> <br />Lot 1, Block 1, RIVERSIDE WEST, Anoka County, Minnesota. <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing <br />pursuant to Section 9.03.05 of the Ramsey City Code on October 21, 1997 and <br />that said public hearing was properly advertised and that the minutes of said <br />public hearing are hereby incorporated as a part of these fmdings by reference. <br /> <br />2. That the subject property is zoned B-3 Highway Business and is approximately 5 <br />acres in size. <br /> <br />3. That the Subject Property is located in the Mississippi Critical River Overlay <br />District and the Wild and Scenic River Overlay District. <br /> <br />4. That the property to the north, west and east is zoned B-3 Highway Business, and <br />the property to the south is zoned R-l Urban Residential. <br /> <br />5. That Section 9.20.23 (B-3 Highway Business District), Section 9.21.07 (Critical <br />River Overlay District Development Standards), and Section Section 9.23.06 <br />(Scenic River Overlay District Development Standards) establishes a structure <br />height restriction of 35 feet. <br /> <br />6. That Section 9.11.15 (permitted Encroachments) states that parapet walls not <br />extending more than four feet above the limiting height of the building are <br />permitted encroachments. <br /> <br />7 <br />
