<br />~ <br /> <br />4. That the Applicant is proposing to construct an accessory structure on the Subject <br />Property . <br /> <br />5. That the required structure setbacks in the B-3 Highway Business District are 35 <br />feet front, 10 feet side and 35 feet rear. <br /> <br />6. The proposed location of the accessory structure meets the front and side yard <br />setback requirements but is only 18 feet from the nearest point of the rear property <br />line and 31 feet from the most distant point of the rear property line. <br /> <br />7. That the Applicant has stated that relocating the accessory building southwest on <br />the Subject Property to meet rear yard setback requirements will deplete the <br />required off-street parking currently provided on the site. <br /> <br />8. That there are unique circumstances applying to the subject property that do not <br />generally apply to other properties in the B-3 Highway Business district; namely, <br />the Subject Property does not quite meet the current 1/2 acre size minimum and is <br />one of the smallest parcels in the Highway #10 corridor. <br /> <br />9. That the Subject Property is entitled to a building coverage of 35% of the lot area; <br />to achieve even the minimal 10% building coverage proposed will require some <br />relief from yard setback requirements so as not to deplete required off-street <br />parking, which is a public safety issue on Highway #10. <br /> <br />10. That such variance is the minimum necessary for the preservation of a substantial <br />property right similar to that possessed by other properties in the B-3 Highway <br />Business District. <br /> <br />11. That the special conditions causing the undue hardship do/do not result from the <br />actions of the Applicant. <br /> <br />12. That if granted, the variance will/wilfnot grant the Applicant any special privilege <br />that is denied to other owners of lands, structures or buildings in the same district. <br /> <br />13. That if granted, the variance will/will not .be materially detrimental to the <br />purposes of the Ramsey Zoning Chapter or other property in the B-3 Highway <br />Business District. <br /> <br />14. That if granted, the variance will/will not substantially increase the congestion of <br />public streets, or increase the danger of fIre, or endanger the public safety, or <br />substantially impair property values within the neighborhood. <br /> <br />~ <br />
