<br />1 <br /> <br />To: City of Ramsey, Minnesota <br />Attn: Sylvia Frolik, Zoning Administrator <br /> <br />From: Gary K. and Bumetta Lien <br />14620 Bowers Drive NW <br />Ramsey, MN 55303 <br /> <br />Subject: Variance Application for Lot 15, Bowers Mississippi Acres <br /> <br />Applications: <br /> <br />This application is for a future home site on Lot 15, and a variance that the home site <br />have a j t; 0 ft. set back from the Mississippi River - the same distance between the river and <br />the residence on Lot 16. <br /> <br />Background: <br /> <br />Lot 15 is part of Bowers Mississippi Acres which was platted and recorded in Anoka <br />County in 1948. <br /> <br />When the City of Ramsey came into existence, the City Ordinance of 1975 recognized <br />this platted and recorded subdivision, and zoned it as RRI (i.e. Rural Residential Single Family). <br /> <br />The City of Ramsey also adopted the Shoreline Protection Act in 1975 which decreed <br />that future subdivisions, lots, etc. bordering the river could not be less than 2.5 acres. <br /> <br />The original Ramsey City ordinances were replaced by a new code in 1985. This new <br />code takes into consideration post 1975 state and federal legislation pertaining to the Mississippi <br />River. <br /> <br />Post 1985 Variance History: <br /> <br />Since 1985, two new homes have been built on the river on Bowers Drive. Both homes <br />were built on lots less than 2.5 acres, and both were approved to have variant setbacks from the <br />Mississippi River that conformed them to existing neighborhood homes. The variant approved <br />homes are located at 14590 Bowers Drive and 14650 Bowers Drive. <br /> <br />Duo Variance Approval: <br /> <br />The applicants are aware that this variance request becomes effective only when <br />approved by the City of Ramsey, and later by the Commissioner of Natural Resources. The <br />Applicants understand that an appeal may be made to District Court - in the event of denial of <br />the variance request by one or both entities. <br /> <br />Factual Information: <br /> <br />The lien's have owned lot 15 since 1978. The title was reviewed, and the lot was <br />considered to be buildable and saleable in accordance with the City Ordinances and the Shoreline <br />Protection Act. Lot 15 is a 1.07 acre lot. (i.e. the largest or nearly so) in the subdivision. It has <br />130 ft. of river frontage, is 330 ft. deep, and is 80 ft. wide at Bowers Drive. Again, Lot 15 was <br />platted in 1948. It has its own pin number, and a separate history and abstract. <br /> <br />15 <br />
