Board Member adoption: introduced the following resolution and moved for its RESOLUTION #97-08-_ A RESOLUTION ADOPTING FINDINGS OF FACT #_ RELATING TO GARY AND BURNETT A LIEN'S REQUEST FOR A VARIANCE TO LOT WIDTH, LOT AREA, AND STRUCTURE SETBACK FROM THE MISSISSIPPI RIVER WHEREAS, Gary and Burnetta Lien, hereinafter referred to as "Applicants", have properly applied for a Board of Adjustment variance from Section 9.21.07 of the Ramsey City Code to develop the following legally described property as a buildable lot with a variance to lot width, lot area, and structure setback from the Mississippi River: Lot 15, Bowers Mississippi Acres, Anoka County, Minnesota (the "Subject Property") NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That the Applicants appeared before the Board of Adjustment for a public hearing pursuant to Section 9.03.05 of the Ramsey City Code on August 5, 1997, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 2. That the Subject Property is zoned R-l Rural Residential and is approximately 1.07 acres in size. 3. That the surrounding parcels are also zoned R-l Rural Residential. 4. That the Subject Property is located in the Scenic and Critical River Overlay Districts. 5. That Section 9.21.07, Subd. l.a of the Ramsey City Code requires a minimum of200 feet of lot width, 2.5 acre lot size, and a 35 foot bluff setback or 200 foot ordinary high water mark setback, whichever is greater. 6. That Section 9.21.07, subd. 2.c.l (Critical River Overlay DistrictlExisting Lots of Record) of the Ramsey City Code indicates that only "lots of record in the office of the County Register of Deeds (or Registrar of Titles) prior to July 29, 1985 (date of enactment) which do not meet the requirements of 9.21.07, subd. 1, may be allowed as building sites provided: 19
