<br />Board Member <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #97-08-_ <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #_ RELATING TO <br />GARY AND BURNETT A LIEN'S REQUEST FOR A VARIANCE TO LOT <br />WIDTH, LOT AREA, AND STRUCTURE SETBACK FROM THE MISSISSIPPI <br />RIVER <br /> <br />WHEREAS, Gary and Burnetta Lien, hereinafter referred to as "Applicants", <br />have properly applied for a Board of Adjustment variance from Section 9.21.07 of the <br />Ramsey City Code to develop the following legally described property as a buildable lot <br />with a variance to lot width, lot area, and structure setback from the Mississippi River: <br /> <br />Lot 15, Bowers Mississippi Acres, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />1. That the Applicants appeared before the Board of Adjustment for a public hearing <br />pursuant to Section 9.03.05 of the Ramsey City Code on August 5, 1997, and that <br />said public hearing was properly advertised and that the minutes of said public <br />hearing are hereby incorporated as a part of these findings by reference. <br /> <br />2. That the Subject Property is zoned R-l Rural Residential and is approximately 1.07 <br />acres in size. <br /> <br />3. That the surrounding parcels are also zoned R-l Rural Residential. <br /> <br />4. That the Subject Property is located in the Scenic and Critical River Overlay Districts. <br /> <br />5. That Section 9.21.07, Subd. l.a of the Ramsey City Code requires a minimum of200 <br />feet of lot width, 2.5 acre lot size, and a 35 foot bluff setback or 200 foot ordinary <br />high water mark setback, whichever is greater. <br /> <br />6. That Section 9.21.07, subd. 2.c.l (Critical River Overlay DistrictlExisting Lots of <br />Record) of the Ramsey City Code indicates that only "lots of record in the office of <br />the County Register of Deeds (or Registrar of Titles) prior to July 29, 1985 (date of <br />enactment) which do not meet the requirements of 9.21.07, subd. 1, may be allowed <br />as building sites provided: <br /> <br />19 <br />
