Skochenski. <br /> <br />Chairperson Deemer called the regular Board of Adjustment meeting back to order at 7: 15 p.m. <br /> <br />BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for A Variance to Construct an Accessory Structure Nearer the Front <br />Property Line than the Principal Structure; Case of Peter Mayer <br /> <br />City Engineer Jankowski stated that staff is recommending approval to allow this variance with the <br />contingency that the accessory structure is placed as far back from the right-of-wa.y as possible <br />because of the 100-foot setback requirement for structures adjacent to county highways. This <br />requirement is mainly geared for residential structures, so that if the highway expands, the right-of- <br />way and traffic are not next to the front door. Staff believes the variance for an accessory structure <br />is reasonable. <br /> <br />Board Member Holland asked for clarification of the setback measurement. <br /> <br />Mr. Mayer stated that a 100-foot setback to comply with code is not possible because of the County <br />road and right-of-way. Therefore, the setback is measured from the center line of County Road 63 <br />for the 60 feet ofright:'of-way and a 35-foot setback from the property line instead of the standard <br />40 feet. <br /> <br />Board Member Holland asked if the structure would be used for any commercial activity. <br /> <br />Mr. Mayer responded, no. <br /> <br />Motion by Board Member Holland and seconded by Board Member Terry to accept the findings of <br />fact Nos. 1 through 10 as presented. <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Board Members Holland, Terry, Jensen, and La <br />Due. Voting No: None. Absent: Board Members Bawden and Thorud. <br /> <br />Motion by Board Member Terry and seconded by Board Member Holland to amend finding No. 11 <br />in the affirmative. . <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Board Members Terry, Holland, Jensen, and La <br />Due. Voting No: None.
