Councilmember Cook introduced the following resolution and moved for its adoption: RESOLUTION #06-02-066 A RESOLUTION APPROVING THE ISSUANCE OF AN AMENDED INTERIM USE PERMIT FOR RETAIL SALES WITH OUTDOOR DISPLAY BASED ON FINDINGS OF FACT AND DECLARING TERMS OF SAME: WHEREAS, on September 26, 2005, Lumax, LLC (Permittee) properly applied for a Conditional Use Permit for the sales and outdoor display of vehicles, as permitted as a conditional use under 9.20.22 of City Code for the property legally described as Lot 10, Auditor's Subdivision #96, Except Road Subject to Easement of Record, Anoka County, Minnesota (Subject Property) WHEREAS, the Planning Commission met on November 3, 2005, conducted the public hearing and recommended City Council denial of the request; and WHEREAS, The City Council met on November 22,2005 and determined that the requested use may be acceptable in the short term and suggested that the Permittee consider an Interim Use Permit, and; WHEREAS, the Permittee agreed to convert the request for a Conditional Use Permit to an Interim Use Permit and; WHEREAS, the owner of the property, Brad Lano, seeks to amend the Interim Use Permit to allow for retail sales with outdoor display areas generally, and; WHEREAS, retail sales and outdoor display is allowed through the issuance of a conditional use permit. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. Based on Findings of Fact #0750, a Interim Use Permit (permit) for retail sales with an outdoor display area is hereby granted to Brad Lano, hereinafter referred to as the "Permitee." 2. That the display area is surfaced with concrete or bituminous. 3. That this use does not take up parking space or loading area as required for conformity to this chapter.
