<br /> <br />Chairperson <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-09- <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONSTRUCT AN <br />ACCESSORY BUILDING NEARER THE FRONT PROPERTY LINE THAN THE <br />PRINCIPAL BUILDING AND DECLARING TERMS OF SAME <br /> <br />WHEREAS, Lynn and Jennifer Bakken (Permittee) have properly applied for a variance <br />from Section 9.11.02 of the Ramsey City Code to construct an accessory building nearer the front <br />property line than the principal building on the property generally known as 6328 Riverdale Dr <br />NW and legally described as follows: <br /> <br />That part of Lot 3, Auditors Subdivision No. 96, Anoka County, Minnesota <br />described as follows: Beginning on the west line of said Lot 3 at a point of 254 <br />feet south of southwest corner of Lot 2 of Auditors Subdivision No. 96; thence east <br />at right angles 109 feet; thence south and parallel with said west line of Lot 3 for a <br />distance of 245 feet more or less to Mississippi River; thence northwesterly along <br />said river to said west line of Lot 3; thence north on said west line of Lot 3 for a <br />distance of 175 feet more or less to the place of beginning; together with an <br />easement for road purposes only from Highway No. 10 over the easterly 17.2 feet <br />of said Lot 3 as measured along the westerly line of Lot 4, Auditors Subdivision <br />No. 96 a distance of 444 feet southerly from said Highway No. 10 and also an <br />additional easement for road purposes only over the westerly 17.2 feet of said Lot 4 <br />beginning at a point 424 feet southerly from Highway No. 10 as measured along <br />the westerly line of said Lot 4 and extending southerly a distance of 240 feet and <br />together with a further easement for road purposes only over the easterly 13.7 feet <br />of said Lot 3 and extending from a point on the easterly line of said Lot 3 distant <br />644 feet southerly from Highway No. 10, as measured along the westerly line of <br />said Lot 4, and extending a distance of 20 feet southerly and there terminating. <br /> <br />(Subject Property). <br /> <br />AND WHEREAS, the Board of Adjustment conducted a public hearing on September 7, <br />2006, pursuant to Section 9.03.07 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That based on Findings of Fact _, a variance to construct an accessory building nearer the <br />front property line than the principal building on the Subject Property is hereby granted. <br /> <br />2. That the accessory building constructed on the Subject Property shall not be located any <br />closer than forty (40) feet from the front property line. <br /> <br /> <br />10 <br />
