Absent: Board Member Brauer. <br />PUBLIC HEARINGS/BOARD BUSINESS <br />Case #1: Request for a Variance from Maximum Front Yard Setback Requirements; <br />Case of Shingobee Builders, Inc. <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:04 p.m. in <br />order to conduct the public hearing. <br />Public Hearin <br />Chairperson Nixt called the public hearing to order at 7:04 p.m. <br />Presentation <br />Associate Planner Dalnes stated that Shingobee Builders, Inc. is proposing to develop Outlot H <br />of Ramsey Town Center. The first phase of the development will include a 15,500 square foot <br />bank. She noted the subject property is zoned TC -2 Town Center Commercial. City Code <br />establishes a minimum front yard setback of 0 feet and a maximum front yard setback of 15 feet. <br />The proposed Klein Bank building is oriented towards Sunwood Drive and fails to meet the <br />maximum front yard setback. She indicated staff would look favorably upon approving the plan <br />the setback from Sunwood Drive, subject to the contingencies in the site plan review letter. <br />Citizen Input <br />There was none. <br />Motion by Chairperson Nixt, seconded by Board Member Trites Rolle, to close the public <br />hearing., <br />Motion Carried. Voting Yes: Chairperson Nixt, Board Members Trites Rolle, Cleveland, Hunt, <br />Levine, and Van Scoy. Voting No: None. Absent: Board Member Brauer. <br />The public hearing closed at 7:07 p.m. <br />Board Member Brauer arrived at 7:08 p.m. <br />Board Business <br />Chairperson Nixt called the Board of Adjustment meeting back to order at 7:07 p.m. <br />Chairperson Nixt stated until the City amends the Code, there will be setback issues in certain <br />situations.
