• <br />• <br />Chairperson Nixt stated the Code said the drive -thru was prohibited and he would recommend <br />denying this. He noted this had nothing to do with the use, but the area where it was being <br />proposed. <br />Commissioner Brauer stated he noticed initially the Council was not in favor of this, but in the <br />end believed this was not such a bad idea. <br />Associate Planner Geisler stated the first time this was brought to Council it was not considered <br />temporary. <br />Commissioner Van Scoy stated this was not an issue of what they were selling, but it was an <br />issue of whether this was a use they wanted to allow. <br />Commissioner Levine stated it was logical to have a drive -thru and it made good sense to have <br />one so he was struggling with this decision. <br />Applicant stated when they laid this out they were very cognizant about traffic flow. He believed <br />having the park and ride where it is, this would be a good asset for this area. <br />Commissioner Trites Rolle stated she was concerned that this would be fairly close to the <br />intersection and she was concerned about traffic back up and traffic congestion. <br />Commissioner Hunt stated he was leaning towards the IUP because in this particular location it <br />was prohibited and across the street it is approved. It made sense to him to have a drive -thru and <br />today's society is demanding drive - thru's. He stated with the IUP they did have control and if a <br />better idea came up, the renewal could be denied. <br />Motion by Commissioner Levine, seconded by Commissioner Hunt, to recommend that City <br />Council adopt findings positive to the request by the applicant for an interim use permit to <br />construct a drive -thru in the TC -1 district. <br />Motion failed. Voting Yes: Commissioners Levine and Hunt. Voting No: Chairperson Nixt, <br />Commissioners Brauer, Cleveland, and Van Scoy. Abstain: Commissioner Trites Rolle. Absent: <br />None. <br />Motion by Chairperson Nixt, seconded by Commissioner Van Scoy to deny the applicant's <br />request for an IUP. <br />Motion carried. Voting Yes: Commissioners Van Scoy, Brauer, Cleveland, and Chairperson <br />Nixt. Voting No: Commissioners Hunt and Levine. Abstain: Commissioner Trites Rolle. <br />Absent: None. <br />Motion by Chairperson Nixt, seconded by Commissioner Van Scoy, to recommend that City <br />Council adopt Findings of negative to the request for an Interim Use Permit to allow the <br />construction of a drive -thru in the Town Center -Core Area District. <br />Planning Commission /August 3, 2006 <br />Page 11 of 16 <br />
