Federal law allows exempt CityCity employees working two or more positions with the CityCity to <br />agree, in advance, to receive overtime compensation for the secondary position if it is non-exempt, <br />subject to certain restrictions and limitations.— Exempt employees holding two or more positions <br />within the CityCity., at least one of which is non-exempt, should consult with Human <br />Resource9Human Resources regarding the possibility of overtime.— No overtime will be paid pursuant <br />to this provision without prior written approval from the City AdministratorHuman Resources. <br />Overtime pursuant to this section will be paid for hours worked in a secondary position only if the <br />employee worked at least 40 hours at the primary position during the normal workweek. —_Sick and <br />vacation leave, holidays,. and compensatory time off count as time worked as per the Personnel Policy. <br />5.5 Payroll Deductions <br />Certain deductions from earnings, such as federal and state income taxes and social security taxes, <br />are required by law.— These deductions will be identified on the direct deposit vouchers.— The <br />amount of these required deductions may change since they are affected by changes in the amount <br />earned, and in the case of income tax, they arc affected by changes in the number of dependents <br />claimed.— Monies earned during a two (2)_ week pay period_, —cannot be divided into two payroll <br />checks.— Employees should contact Human RcsourceaHuman Resources with any specific <br />questions. <br />5.6 Meal Periods and Breaks <br />When working under conditions where a break period is practicable, all hourly employees are <br />entitled to two (2) 15 minutel5 minute breaks with pay per eight (8)7hour shift at times designated <br />by the supervisor.— Most employees also receive a thirty (30)7minute unpaid meal period during <br />each eight houreight-hour work day.— Employees working greater than four hours; but less than <br />eight hours are entitled to one (1) 20-minute break. <br />5.7 Overtime Compensation' Compensatory Time Off <br />Non-exempt, non -union employees will be paid overtime compensation for all hours worked in <br />excess of forty (40) hours per work -week at a rate of one and one-half times the regular rate of pay. <br />Paid holidays, vacation leave, compensatory time off, and sick leave are considered time worked <br />for the purposes of calculating overtime hours.— No employee will be permitted to work overtime <br />without the prior approval of the applicable Department Head. <br />Overtime pay will not be paid for time not worked. Exempt employees, as defined by the Fair <br />Labor Standards Act, are not entitled to overtime pay, except as described in Ssection 5.4.2 <br />pertaining to exempt employees who also work in a non-exempt position within the 6i4yCity. <br />Non-exempt, non -union employees will be allowed to take compensatory time off in lieu of <br />receiving over time compensation.— Compensatory time off is computed at a rate of one and one- <br />221Page <br />
