C, flict <br />When conflicts arise, the interested elected official must: <br />1. Prepare a written statement or make a verbal announcement at the applicable public <br />meeting, describing the matter requiring action or decision and the nature of the potential <br />conflict of interest. <br />a) Deliver a copy of the notice to the presiding officer (typically the mayor), <br />b) If the mayor has the conflict, the notice should be deliveredge to the acting presiding <br />officer. <br />PROCEDURE WHEN STAFF HAVE CONFLICT roccdurc iM cn Staff/,,.v„ a Conflict <br />1. Each staff member has a duty to disclose to the City Administrator, Finance Director and/or <br />Administrative Services Director of the City the material facts of any proposed transaction <br />of the City in which such person has any conflict(s) identified by this policy. Staff shall <br />prepare a written statement describing the matter requiring action or decision and the nature <br />of the potential conflict of interest. <br />12.The disclosure required under item 1 (above) is to be made immediately , —and, to the extent <br />possible, before any consideration of such proposed transaction by the City. If a staff <br />member does not recognize the existence of a conflict prior to a decision regarding the <br />transaction, the staff member has a duty to disclose the material facts of the conflict as soon <br />as it is recognized. <br />23.A staff member having a conflict shall not participate in the deliberation or decision by the <br />City regarding the transaction under consideration_ -unless invited by the City Council, City <br />Administrator, Finance Director, and/or Administrative Services Director to do so, after <br />consideraticonsideringon of the significance to the City of the disclosed conflict to the City. <br />The City Council, City Administrator, Finance Director, and/or Administrative Services <br />Director of the City may also request that the staff member he or she provide the City with <br />any relevant information regarding the matter. <br />The City Council, City Administrator, Finance Director and/or Administrative Services Director of <br />the City shall take anysash additional actions necessary as may be required to ensure that the <br />conflict is properly notice disclosed to management and that appropriate steps are taken employed <br />as the transaction and its terms are brought forth for decision -making and/or implementation. <br />Furthermore, the City Administrator, Finance Director, and/or Administrative Services Director of <br />the City shall maintain a record of the existence of the conflict, the; procedures employed in <br />managing it, and its resolution of the conflict. <br />641Page <br />
